Abstract
The present study intends to evaluate the effect of the law on family structures and analyze its economic consequences. First, it carries out a comparative analysis of the regulation of family structure among the legal systems of the western countries. From the aforementioned regulation, both the divorce legislation of each country and the one concerning the custody of the children are examined comparatively. In reference to child custody regulation, a separate examination of single-parent custody and shared custody is implemented. Secondly, once the analysis and comparison of these laws has been fulfilled, the economic consequences which they imply are examined. On the one hand, the consequences of the current legal regulation of divorces are studied, analyzing the social trends regarding this matter and its economic effects. On the other hand, an analysis of the two types of child custody is carried out, examining the family situations caused by each of them, such as the division of hours of family members or the effects on the minor development, among other aspects. Each of the areas relates to the economic and psychological consequences of each one of the parts involved. Finally, the work concludes with a summary of the legislation analysed and the effects of the family structure laws over the economy and welfare of the citizens affected by them.
